Notice to Creditors to Claim

Pritesh Patel, Licensed Insolvency Practitioner (IP120) was appointed as Liquidator of the company by a special resolution of the shareholder on 31 May 2023 at 10.30am

The registered office of the Company is at the offices of Patel & Co, 344 Great South Road, Papatoetoe, Auckland, New Zealand 2241.

The liquidator on 2 June 2023 gave public notice that he fixed 6 July 2023 as the day on or before which the creditors of the Company are required to make their claims, and to establish any priority their claims may have under section 312 of the New Zealand Companies Act 1993.

Pursuant to regulation 13(1) of the New Zealand Companies Act 1993 Liquidation Regulations 1994 creditors who have failed to make their claim shall be excluded from the benefit of any distribution made before his or her claim is made.

If you are a creditor of the Company who has not previously made a claim or established any such priority then you should do so as a matter of urgency.

NOTICE IS HEREBY GIVEN THAT THE COMPANY INTENDS TO MAKE A DISTRIBUTION AFTER ONE MONTH FROM THE DATE OF THIS NOTICE. ANY CREDITORS OF THE COMPANY WHO HAVE NOT PREVIOUSLY FILED A CLAIM, OR ESTABLISHED ANY PRIORITY THEIR CLAIMS MAY HAVE UNDER SECTION 312 OF THE NEW ZEALAND COMPANIES ACT 1993, AND DO NOT DO SO WITHIN ONE MONTH FROM THE DATE OF THIS NOTICE, WILL BE EXCLUDED FROM THE BENEFIT OF ANY DISTRIBUTION MADE BEFORE THEIR CLAIM/S ARE MADE.

Any creditors who have not previously made a claim must make a claim in the proof of debt form which is exhibited to the liquidator’s first report dated 7 June 2023. The report is available from the NZ Companies Office Website www.companies.govt.nz. The creditors should send the completed proof of debt form including their names and addresses, particulars of their debt or claims and the names and addresses of their Solicitors (if any) to the Liquidator: Pritesh Patel of Auckland New Zealand care of both the PO Box and email addresses set out below.
