AMENDMENT TO ARTICLE 80 OF THE CODE OF CIVIL PROCEDURE OF LITHUANIA (SIZE OF THE OFFICIAL FEE)

A new edition of the Code of Civil Procedure of the Republic of Lithuania (hereinafter – the Code) has entered into effect on Oct. 1, 2011. A few amendments to Article 80 of the Code concerning the size of the official fee have been adopted:
- Each statement of claim in disputes arising from a lease (except for recovery of money) shall require the payment of the official fee of 200 litas.
- Each statement of claim concerning the modification (adjustment, termination, etc.) of a contract shall require the payment of the official fee of 500 litas.
- Each statement of claim in disputes regarding investigation of a legal entity’s activities and cases where decisions of public procurement are being contested shall require the payment of the official fee of 1,000 litas.
- Separate appeals against a court ruling on the imposition of provisional safeguards shall require the payment of the official fee of 100 litas.
- For a petition for review of a default judgment, an official fee of 100 litas shall be payable.
- For petitions for reopening the proceedings an official fee of the same size as that to be paid in filing the statement of claim shall be paid.
- A request to impose provisional safeguards or measures of evidence safeguarding or collecting (before the date of a claim lodging to the court) shall require the payment of the official fee of 200 litas.
- For a petition of an arbitration decision, an official fee of 1,000 litas shall be payable.
