VILNIUS - The European Union's General Court has issued a final dismissal of a lawsuit filed by Klaipeda port handling company Bulk Cargo Terminal, controlled by Igor Udovickij, over sanctions prohibiting the transit of Belarusian potash fertilisers through Lithuania, public broadcaster LRT reported.
According to LRT, the court rejected the entire claim on Wednesday, in which Bulk Cargo Terminal sought to compel the European Union Council to adopt new rules or exemptions for transit. As a result, Bulk Cargo Terminal was ordered to cover the legal costs. The decision was based on the finding that the company had filed its appeal after the deadline and that the court did not have the authority to amend European Union Council decisions.
In May last year, the European Union General Court had already dismissed part of Bulk Cargo Terminal's lawsuit challenging restrictive measures adopted by the European Commission. Those measures led to the Lithuanian government's February 2022 decision to end the transit of Belaruskalij fertilisers through the port of Klaipeda. However, proceedings continued regarding the remaining part of the claim.
The transit of Belaruskalij products from the Belarusian border to the port of Klaipeda had operated for more than a decade and was scheduled to continue until the end of 2023, but was halted on February 1, 2022.
